Terms of Service

Agreement between User and Tricoda Ltd. For the purposes of these terms, unless otherwise noted, all references to Tricoda Ltd include https://tricoda.com and tricoda.com and are used interchangeably.

Welcome to Tricoda. The https://tricoda.com website (the "Site") is comprised of various web pages operated by Tricoda Ltd ("Tricoda.com"). Tricoda.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of Tricoda.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

Your use of tricoda.com is subject to our Privacy Policy . Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications
Visiting tricoda.com or sending emails constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that tricoda.com is not responsible for third party access to your account, servers, or code that results from theft or misappropriation of your tricoda.com account. Tricoda.com and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Children Under Thirteen
Tricoda.com does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use tricoda.com.ie only with permission of a parent or guardian.

Cancellation Policy
You may cancel your paid subscription at any time by logging into your account, navigating to the billing page and clicking the cancel my paid plan link.

Links to Third Party Sites/Third Party Services
Tricoda.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of tricoda.com and tricoda.com is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Tricoda is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Tricoda of the site or any association with its operators.

Third party sites and organizations deliver certain services made available via tricoda.com. By using any product, service or functionality originating from the tricoda.com domain, you hereby acknowledge and consent that tricoda.com may share such information and data with any third party with whom tricoda.com has a contractual relationship to provide the requested product, service or functionality on behalf of tricoda.com users and customers.

No Unlawful or Prohibited Use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use tricoda.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to tricoda.com that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner, which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Tricoda Ltd or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Tricoda.com content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of tricoda.com and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of tricoda.com or our licensors except as expressly authorized by these Terms.

Third Party Accounts
You will be able to connect your tricoda.com account to third party accounts. By connecting your tricoda.com account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

International Users
The Service is controlled, operated and administered by tricoda.com from our offices within the EU. If you access the Service from a location outside the EU, you are responsible for compliance with all local laws. You agree that you will not use the tricoda.com Content in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Subscriber agrees to indemnify and hold harmless Tricoda Ltd , and each of their respective officers, directors, agents, and employees from and against any and all claims, demands, liabilities, obligations, losses, damages, penalties, fines, punitive damages, amounts in interest, expenses and disbursements of any kind and nature whatsoever (including reasonable legal fees) brought by a third party under any theory of legal liability arising out of or related to the actual or alleged use of Subscribers services in violation of applicable law or the AUP by Subscriber or any person using Subscriber’s log on information, regardless of whether such person has been authorized to use the services by Subscribe

Disclaimer of warranties
Tricoda does not warrant or represent that the services will be uninterupted, error-free, or completely secure. To the extent permitted by applicable law Tricoda disclaims any and all warranties including the implied warranties of merchantability, fitness for a particular purpose, and non infringement. To the extent permitted by applicable law, all serices are provided on an "as is" basis.

Limitation of liability
In no event will Tricoda Limited, its suppliers, or third parties mentioned on this site be liable for any special, indirect or consequential or any damages whatsoever (including, without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of this site, any web sites linked to this site, or the materials or information contained at any or all such sites, or in connection with the use or performance of software or of failure to provide services, whether based on warranty, contract, tort, negligence or any other legal theory and whether or not advised of the possibility of such damages.
Law enforcement information
The Tricoda terms specifically prohibits the use of our service for illegal activities. Therefore, Subscribers agree that the company may disclose any and all the account holders information including assigned IP numbers, account history, account use, etc. to any member of An Garda Siochana (Police of Ireland) who makes a written request, without further consent or notification to the Subscriber. In addition Tricoda shall have the right to terminate all service set forth in this Agreement.

Invoicing and payment
You agree that Tricoda shall be permitted to charge your credit card on a monthly, annual or other agreed upon basis in advance of providing services.
Payment is due on invoicing unless cancellation is requested.
Any payments not made within 7 days of due date will have the associated service suspended without further notice, until payment is made.
Any suspended service will be terminated and destroyed after 30 days without further notice.
Subscribers are aware that Tricoda may prospectively change the specified rates and charges from time to time in accordance with foreign exchange rates.
Subscriber is responsible for any additional Bank fees, interest charges, finance charges, overdraft charges or any other fees resulting from charges billed by Tricoda.
Once service has commenced, the subscriber agrees that the minimum term of service applies and no refunds will be provided.
When an account becomes overdue Tricoda reserves the right to suspend active and paid-for services until such time outstanding unpaid invoices are settled.

Suspension and cancellation
Tricoda reserve the right to suspend network access to any Subscriber if, in the sole judgement of Tricoda, the Subscribers server is the source or target of a violation of any of the other terms of service or the Subscribers account is in arrears of one month or more, or for any other reason which Tricoda chooses.

Tricoda will use all reasonable care in notifying the Subscriber and in resolving the issue in a method ensuring the minimum service interference. Continued and repeated violations of the terms of service will result in termination without refund. Prior notification is not assured. Subscribers may cancel service at any time using the ‘Request Cancellation’ links in your GUI, which is under the Billing Tab for each service. Account cancellation requests can not be accepted by email, ticket or chat. Accounts are cancelled upon confirmation with you by Ticket. Cancellation of a service does not relieve Subscriber of responsibility for the payment of all accrued charges. Accounts can not be confirmed Cancelled until all due invoices have been settled. Non confirmation of the cancellation may result in charges continuing to be levied.

You agree that Tricoda may provide you with notices, including those relating to changes to the Terms of Service by Email and/or postings on Tricoda systems and services.
